Lower sentences on appeal in trial over failed assassination attempt on lawyer (UPDATE)

On appeal, the Arnhem-Leeuwarden Court of Appeal sentenced Bert-Jan ten V. (50) and Maikel TT (34) to prison terms of more than 17 and 15 years for an assassination attempt on Dutch lawyer Philippe Schol in Gronau, Germany. The sentences in the trial are much lower than those imposed by the court: 23 and 18 years respectively. The court acquitted one of the suspects of attempted murder when he fired shots at a gym.

Schol was shot on the street from a moving car just after 8 a.m. on November 6, 2019. The two suspects were in the car, but the court was unable to determine which of them fired the shot.

The lawyer suffered permanent injuries. One of the five bullets hit his thigh and caused arterial bleeding. He will probably have pain and discomfort for the rest of his life.

The court also convicted one of the men for shooting at a gym in Losser, Twente. The same firearm was used in both shooting incidents.

Assassination attempt

The court assumes that the attack on the lawyer is related to his work as a curator.

The gym was shot at on October 2, 2019 (see photo). There were four bullet holes in the windows of the canteen. One visitor was present in the gym during the shooting. She was not in the cafeteria, which was empty and locked. Ten V. has confessed to having shot at the gym. Unlike the court, the court finds that there was no attempted murder, because there was no one in the closed canteen. The court ruled that the shooter was guilty of threats and destruction by shooting.

The man whom investigators suspected of being the perpetrator of the attack, a gym owner from Twente, was not brought to justice.

Ten V. receives a much lower sentence than in court, partly because he had a clean criminal record, he was acquitted of attempted murder and because the case took too long. TT also receives a slightly lesser sentence, because the criminal case took too long.
