Higher prison sentence and TBS on appeal for shooting Bas van Wijk



On Friday, the court in Amsterdam sentenced 23-year-old Samir El Y. on appeal to 11.5 years in prison and TBS with compulsory treatment for the shooting death of Bas van Wijk in the summer of 2020. Due to an error in the indictment, the court El Y. earlier 9 years in prison and TBS with compulsory treatment. The demand of the Public Prosecution Service on appeal was 16 years in prison plus TBS.

On August 8, 2020, Bas van Wijk (24) from Badhoevedorp was with a group of friends on a recreational jetty on the Nieuwe Meer in Amsterdam Nieuw-West. Samir El Y. was also there with three others. After a disagreement between the two groups about looking at each other, El Y. walked over to the other group. There he took a gun from the pocket of his swimming trunks and summoned one of Van Wijk’s friends to hand over his watch. However, he refused this.

Two bullets

El Y. then reloaded the gun and shot past a second man’s knee, while a third man stood nearby. The shooter was approached by Bas van Wijk, after which El Y. fired two bullets that hit the victim in his left leg and upper body. The watch of the other man was then handed over under duress. With that, El Y. fled from the crime scene. Van Wijk died in hospital from his injuries.

During the appeal hearing, it became clear what immense void his death has left with the next of kin. Their lives are completely disrupted. The events also had an enormous impact on the three mentioned men from the group.

Qualified manslaughter

According to the court, Samir El Y. is guilty of qualified manslaughter. The court previously sentenced him to 9 years in prison and TBS with compulsory treatment for manslaughter alone. The indictment in the first instance accidentally failed to state the place and date of the crime in the case of suspected aggravated manslaughter (manslaughter and robbery). As a result, the court could not rule on qualified manslaughter but only on manslaughter. Higher penalties apply for qualified manslaughter.

In addition to qualified manslaughter, El Y. is also convicted of extortion, two threats and possession and transfer of firearms. Due to the seriousness of the facts, but also taking into account the fact that El Y. has reduced responsibility, the court finds a prison sentence of 12 years appropriate.

Long-term treatment

Due to the too long duration of the appeal procedure, the court imposed a prison sentence of 11.5 years and a TBS with compulsory treatment. The shooter has a serious personality problem that requires long-term treatment to limit the risk of future violent behavior.
